In an effort to increase transparency between manufacturers and health care providers, the proposed 2009 Physician Payments Sunshine Act places an enormous compliance burden on pharmaceutical, biotechnology and medical device companies. Currently, the House and Senate are developing bills that will require manufacturers to report the aggregate of compensation given to each health care provider, over a decided upon threshold amount. This means that money spent, per physician, on gifts, honoraria, consulting fees, food, research, continuing medical education and clinical investigator payments will be made public. Manufacturers must work quickly and effectively to ensure that that all data related to their financial relationships with health care practitioners are captured, monitored, and can be reported accurately. The initiative demands an enormous amount of time, effort as well as dollars from the industry. In addition, the federal law will not preempt state laws, meaning that companies will have to abide by any additional reporting mandated by individual states. Industry compliance departments are charged with adhering to a patchwork of, at times, complicated and conflicting reporting requirements across the nation.
